The Win a Trip to Fiji Sweepstakes ("Sweepstakes") is offered only in the United States ("Territory") and is open only to legal residents of the United States who are 18 or over, as of date of entry: if you do NOT reside in Territory or are otherwise ineligible, do NOT attempt to enter the Sweepstakes. Employees, officers and directors and their immediate family members (parents, children, siblings, spouse) wherever they may live and others living in their same household (whether related or not) of Eagle Creek, a division of VF Outdoor, Inc. ("Sponsor"), Air Pacific, Tourism Fiji and Radisson Resort Fiji Denarau Island, their respective parent companies, subsidiaries, affiliates, suppliers, and their advertising, promotion or production agencies are not eligible to enter the Sweepstakes or win a prize. Sweepstakes begins on July 1, 2009 and ends on August 31, 2009 ("Sweepstakes Period"). Void outside Territory and where prohibited by law.
1. To Enter. During Sweepstakes Period, enter in one of the following ways: A) In-Store. Complete an entry form and deposit it in the specially marked entry box located at any participating Eagle Creek retailer by close of business on August 31, 2009. B) By Mail. Complete entry form and mail it in a business size (#10) envelope with proper postage affixed to Win a Trip to Fiji Sweepstakes, Eagle Creek, 3055 Enterprise Court, Vista, CA 92081, to be postmarked by September 1, 2009 and received by September 9, 2009. C) Online. Go to www.eaglecreeksweeps.com, follow the prompts and input all requested information (including your name, daytime phone number and e-mail address [if any]) on on-line entry form between July 1, 2009 on or about 12:00:01 a.m. Pacific Time (PT) and August 31, 2009 at 11:59:59 p.m. PT. Provision of information on online entry is subject to privacy policy available at www.eaglecreek.com. Entry forms contain optional survey questions and the content of your answers to survey questions (and whether you choose to answer them at all) will not affect your ability to enter the Sweepstakes or your chances of winning. To enter if a participating Eagle Creek retailer runs out of entry forms, print your name, complete address, daytime phone number, and e-mail address (if any) on a 3x5 card. Print on the card that you have read and agree to these Win a Trip to Fiji Sweepstakes Official Rules, sign the card, and mail it in a business size (#10) envelope with proper postage affixed to the above address by the indicated deadlines for entry by mail (see B). No copied or mechanically reproduced entry forms or 3x5 cards will be accepted. Once submitted, entries become the property of Sponsor and will not be acknowledged or returned; proof of depositing/mailing/transmitting entry form does not constitute proof of entry. LIMIT ONE ENTRY PER PERSON OR E-MAIL ADDRESS. Any person who attempts to participate with multiple e-mail and/or street addresses, under multiple identities or uses any device or artifice to enter multiple times will be disqualified. Online entries must be manually key-stroked. Online entries generated by script, macro, robotic, programmed or like means are prohibited and will be disqualified. In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the Authorized Account Holder of the e-mail account from which the online entry is submitted as of date of entry. Authorized Account Holder means the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
2. Winner Determination. On or about October 31, 2009, winners will be selected in a random drawing from among all eligible entries received. The drawing will be conducted by Eagle Creek. By participating, entrants accept and agree to abide by and be bound by these Official Rules and the decisions of the Sponsor, which are final and binding in all respects. Persons initially selected as winners will be notified by phone and/or e-mail and/or mail within (2) business days of drawing.
3. Prizes/Odds of Winning: Grand Prize (1): One five-night trip to Fiji for the winner and one (1) travel companion. Trip consists of round-trip international economy class air travel from Los Angeles to Nadi, Fiji, five nights lodging at the Radisson Resort Fiji Denarau Island and roundtrip transfers from Nadi airport to resort. Continental breakfast (excluding alcoholic beverages) is included at the resort. Grand Prize also includes a set of Eagle Creek luggage. Approximate retail value of Grand Prize: $ 4,000. Actual value of trip depends on airfare fluctuations and other factors and winner will not receive difference between approximate retail value and actual value of trip. Second prize (1): set of Eagle Creek luggage (approximate retail value: $500). Third prize (1): Eagle Creek ORV Trunk or a Tarmac 22. luggage (approximate retail value: $270). Odds of winning depend on the total number of eligible entries received.
4. Prize Restrictions. For Grand Prize: Trip is subject to availability and blackout dates as well as certain other restrictions. Prize travel must be completed by September 1, 2010 and winner must provide at least (45) days. advanced notice prior to intended date of departure. Winner and travel companion will be solely responsible for obtaining any and all required travel documents (including passport), all necessary immunizations and any desired travel insurance solely at their own expense. All land arrangements (in Fiji) must be finalized 30 days before intended departure date. Air tickets must be requested and issued at least 30 days before intended departure date. Winner and companion must travel on same itinerary. Airline reservations must be made with Air Pacific. Rebooking and changes are not permitted. No refunds or other credits will be provided if winner is not able to take the trip. All travel must be completed within 90 days from the date of issuance (but in no event later than September 1, 2010). Tickets are non-refundable and non-transferable and are subject to government regulations. Travel is subject to schedule changes and may only be used on Air Pacific operated services. This award is excluded from frequent flyer mileage credit and does not include code share flights. These tickets are not subject to any denied boarding policy. This award may not be sold to, bartered with, purchased or utilized by a third party. For All Prizes: All expenses related to acceptance or use of any prize which are not specified in these Official Rules as well as all applicable taxes on prize are winner.s sole responsibility. No prize substitution, except by Sponsor, in its sole discretion, if advertised prize/prize component is unavailable for any reason and only then for prize/prize component of equal or greater value. No prize transfer. Limit (1) prize family/address/household.
5. Conditions of Participation. Grand Prize winner will be required to complete, execute and return an affidavit of eligibility, a liability release and a publicity release (where legal) within (7) days of date of prize notification materials. Travel companion of Grand Prize winner must complete, execute and return a liability release and a publicity release (where legal), prior to issuance of travel documents. If travel companion is a minor in his/her jurisdiction of residence, travel companion.s parent or legal guardian must be the Grand Prize winner and Grand Prize winner must sign documents on behalf of minor. In the event of non-compliance with these requirements or if prize notification for any prize is returned as undeliverable for any reason, such prize will be forfeited without compensation and an alternate winner selected from among all remaining eligible entries received. By accepting prize, except where prohibited by law, winner agrees to the use of his/her name, address (city, state), likeness, voice, photograph and/or other indicia of persona for advertising/publicity/trade purposes by Sponsor and its designees without further compensation or notice. By participating, entrant indemnifies, releases and agrees to hold harmless VF Outdoor, Inc., Air Pacific, Tourism Fiji, Radisson Resort Fiji Denarau Island, their respective parents, affiliates and subsidiaries, promotion marketing/advertising agencies, and the directors, officers, agents, representatives, shareholders, and employees of any of the above organizations (.Released Entities.) from any and all liability arising from participating in the Sweepstakes, any Sweepstakes-related activity and/or acceptance, receipt, possession or use/misuse of any prize. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds, in its sole discretion, to be tampering (or attempting to tamper) with the entry process or the operation of the Sweepstakes or any web site; to be acting in violation of the Official Rules or to be acting in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
6. Limitations of Liability: Sponsor.s computer is the official clock for purposes of the online component of Sweepstakes. Sponsor and its agencies assume no responsibility for (a) any incomplete, incorrect or inaccurate information, whether caused by web site users, tampering, hacking or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error; (b) any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of any web site and/or entries; and (c) any problems or technical malfunctions of any telephone network or lines, computer on-line-systems, servers or providers, computer equipment, software, programming or failure of e-mail on account of technical problems or traffic congestion on the Internet or at any web site or any combination thereof, or for injury or damage to entrant.s or to any person.s computer (or any information/materials stored therein) related to or resulting from downloading materials from any web site or participating in Sweepstakes. Sponsor and its agencies are also not responsible for late, lost, illegible/garbled, incomplete, damaged, stolen, misdirected entries or postage due mail. If, for any reason, Sponsor determines in its sole discretion that the Sweepstakes (in whole or in part) is not capable of running as originally planned, including without limitation infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which, in Sponsor.s sole discretion, could corrupt or affect the administration, security, fairness, integrity or proper conduct of the Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes. In such event, Sponsor will select the winners by a means deemed by Sponsor in its sole discretion to be fair, appropriate and consistent with the spirit of these Official Rules. And, notice of such action will be posted on www.eaglecreek.com.
7. DISPUTE RESOLUTION/GOVERNING LAW/WAIVER OF JURY TRIAL:
Except where prohibited, by participating in the Sweepstakes, you agree that: (a) any action at law or in equity arising out of or relating to these Official Rules or the rights and obligations of any entrant and/or Eagle Creek, a division of VF Outdoor, Inc., shall be filed exclusively in the federal or state courts of California, and you hereby consent and submit to the personal and exclusive jurisdiction of such courts for the purposes of litigating any such action (and waive any right to change of venue, forum non conveniens, or any like right) AND ANY RIGHT TO A TRIAL BY JURY AND A TRIAL BY JURY IS ALSO HEREBY WAIVED, (b) any and all disputes, claims, and causes of action arising out of or connected with these Official Rules, and/or the rights and obligations of any entrant and/or Eagle Creek, a division of VF Outdoor, Inc., shall be resolved individually, without resort to any form of class action, and (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with participating in this Sweepstakes but in no event attorneys' fees; and (d) under no circumstances will any entrant be permitted to obtain awards for and hereby waives all rights to claim punitive, exemplary, special, incidental, indirect and consequential damages and any other damages (whether due to negligence or otherwise), other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of any entrant and/or Eagle Creek, a division of VF Outdoor, Inc., shall be governed by and construed in accordance with the laws of the State of California without giving effect or regard to any principles or doctrines of conflicts of law/choice of law of State of California or of any other jurisdiction.
8. Winners. List: For the names of winners (available after October 31, 2009; requests must be received by November 16, 2009), send a self-addressed, stamped envelope to: Win a Trip to Fiji Sweepstakes, 3055 Enterprise Court, Vista, CA 92081. This Sweepstakes may not be published elsewhere without the written permission of Sponsor.
